Terms of Use

1. Acceptance of Terms

By downloading, installing, accessing, or using Nestio ("the App", "Nestio"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and the Developer (Dev Lab). The App is intended for use by adults aged 18 or older — parents, legal guardians, and professional caregivers only. By using Nestio, you represent and warrant that you meet this age requirement and that you have the legal authority to enter into this agreement.

2. Description of Service

Nestio is an all-in-one baby and child activity tracker designed to help parents and caregivers log, monitor, and review daily care activities. Core features include:

• Child Profiles: Create and manage profiles for one or more children, including name, birth date, gender, profile color, comment, and optional avatar photos.
• Feeding Tracker: Breastfeeding timer with left/right side tracking, bottle feeding with volume logging (ml / fl oz), solid food diary, and feeding analytics (average intervals, longest session, hourly distribution).
• Sleep Tracker: One-tap day and night sleep timer, sleep duration charts by day/week/month, insights including longest sleep, nightly average, and hourly activity heatmap.
• Diapers & Hygiene: Quick logging of wet, soiled, or dry diapers; daily change counter; bath, massage, walk, and tummy time logging.
• Growth & Development: Track weight, height, and head circumference (metric & imperial units); interactive teeth chart; solid food introduction timeline.
• Health Log: Body temperature history, doctor visits and specialist appointments, symptoms and well-being diary, vaccination and immunization schedule tracker, and medications / vitamins / supplements log.
• Custom Events: Create any activity with timer, quantity field, and free-text notes (e.g., tummy time, games, crying, nail trimming).
• Statistics & Analytics: Interactive charts by day, week, and month; hourly activity heatmap; period-over-period trend comparison; export to CSV and PDF.
• Smart Reminders: Reminders based on last recorded event, exact-time and recurring notifications, Do Not Disturb mode with configurable quiet hours, repeat on specific days of the week.
• Multiple Child Profiles: Track multiple children and switch between profiles instantly from the home screen.
• Home Screen Widget: View latest events and active timers directly on the device home screen.

All child-related data you enter is stored locally on your device in an encrypted SQLite database. The Developer does not collect, access, or process this data.

3. License and Restrictions

3.1 License Grant

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on compatible mobile devices for your personal, non-commercial use.

3.2 License Restrictions

You agree not to, and will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make it available to any third party.
• Modify, translate, adapt, reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App.
• Create derivative works based on the App or any part thereof.
• Remove, alter, or obscure any proprietary notices, labels, or marks on the App.
• Use the App for any unlawful purpose or in any manner inconsistent with these Terms or applicable law.
• Interfere with or disrupt the integrity, security, or performance of the App or its related systems.
• Circumvent any technical measures used to protect the App or its features.

4. User Accounts and Data

4.1 No Account Required

Nestio does not require you to create an online account or provide personal information to the Developer. All data is stored locally on your device.

4.2 User-Generated Content

You are solely responsible for all data, information, photos, and content ("User Content") that you enter, upload, or store within the App, including child profiles, avatar photos, and activity records. You retain ownership of your User Content.

4.3 Local Data Responsibility

Because all personal data is stored locally on your device:

• You are responsible for maintaining backups of your data. The Developer cannot recover your data if your device is lost, damaged, reset, or malfunctioning.
• Uninstalling the App will delete all locally stored data unless you have previously exported it.
• The Developer does not have access to your data and cannot restore, recover, or transfer it between devices.
• You may export your data at any time via the app's History screen as CSV (Excel-ready) or PDF files through your device's native share sheet.

5. Advertising

5.1 Advertisements

The free version of Nestio displays advertisements served by Google Mobile Ads (AdMob), including banner ads, interstitial ads, and rewarded video ads. Ads are configured to serve non-personalized ads where required by applicable law.

Google may collect device identifiers and ad interaction data according to Google's Privacy Policy. Your use of the App is also subject to Google's advertising terms.

5.2 Rewarded Video Ads

Certain features or content within the App may be unlocked temporarily by viewing rewarded video advertisements. Rewarded unlock status is tied to the specific child profile and feature, and may expire based on the reward duration defined in the App.

6. Third-Party Services

The App integrates with or uses the following third-party services:

Your use of these third-party services is subject to their respective terms and privacy policies. The Developer is not responsible for the content, policies, or practices of these third parties.

7. Intellectual Property

The App, including its source code, architecture, design, graphics, logos, trademarks, trade names, icons, and all related content, is the exclusive property of the Developer and is protected by copyright, trademark, and other intellectual property laws.

You may not use the Developer's trademarks, logos, or other proprietary information without prior written consent. Nothing in these Terms grants you any right, title, or interest in the App or its content except for the limited license expressly granted herein.

8. Medical Disclaimer

• Always consult a qualified healthcare provider or pediatrician with any questions you may have regarding your child's health, growth, nutrition, or medical conditions.
• Never disregard professional medical advice or delay seeking it because of information you have read, recorded, or calculated in this App.
• The App does not verify, validate, or guarantee the accuracy, completeness, or usefulness of any health-related data tracked or calculated.
• You assume full responsibility for all health-related and caregiving decisions made based on data entered into the App.
• The Developer expressly disclaims any liability for health outcomes, missed diagnoses, or delayed treatment resulting from use of the App.

9. Disclaimers and Limitation of Liability

9.1 No Warranty

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

The Developer does not warrant that:

• The App will function uninterrupted, secure, timely, or error-free.
• Any errors or defects in the App will be corrected.
• The App is free of viruses, malware, or other harmful components.
• Local data storage is completely secure against all forms of device compromise, loss, or failure.
• The results of using the App will be accurate, reliable, or suitable for your specific needs.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, the App.
• Any conduct or content of any third party on or related to the App.
• Any content obtained from the App.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of your use of the App.
• Loss of local data due to device failure, uninstallation, or lack of backup.
• Any health-related decisions or outcomes arising from the use of the App.

THE DEVELOPER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, IF ANY, OR ONE U.S. DOLLAR (US$1.00), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Developer, its affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms.
• Your User Content or any data you enter into the App.
• Your use of the App, including any health-related or caregiving decisions made based on App data.
• Your violation of any rights of another party, including intellectual property rights.
• Your violation of any applicable law or regulation.

11. Termination

These Terms remain in effect until terminated by either party.

• By You: You may terminate these Terms at any time by uninstalling the App and ceasing all use.
• By Us: We may suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms or applicable law.

Upon termination, all licenses granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination shall survive, including but not limited to Intellectual Property, Medical Disclaimer, Disclaimers and Limitation of Liability, Indemnification, and Governing Law.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is established, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved informally within thirty (30) days, it shall be subject to the exclusive jurisdiction of the courts of the Developer's jurisdiction.

If you are a consumer in the European Union, you may also be entitled to submit disputes to an EU-based alternative dispute resolution body. Nothing in these Terms affects your statutory rights as a consumer under applicable law.

13. Changes to These Terms

We reserve the right to modify, amend, or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, either within the App, via the contact email you have provided, or by updating the effective date at the top of this document.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, you must stop using the App and uninstall it.

14. Export Controls

You may not use or otherwise export or re-export the App except as authorized by the laws of the jurisdiction in which the App was obtained. You represent and warrant that you are not located in any country or on any government denied-party list where use of the App is prohibited by applicable law.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if not possible, severed from these Terms without affecting the validity of the remaining provisions. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the use of the App and supersede all prior agreements, understandings, or representations, whether written or oral, regarding the App.
